Limited Warranty Terms

This Limited Warranty is issued by Adventure Power Bikes ("APB"), a San Diego, CA corporation. It is applicable to products listed on the adventurepowerbikes.mx website purchased in the Republic of Mexico.

This Limited Warranty extends to the original purchaser of the Warranted Products under this Limited Warranty and to each transferee of the Warranted Products for the terms set forth below, provided that the products were originally purchased from the RPB online store, an APB physical store, or an authorized APB retail partner. If the products were purchased through an APB retail partner, a proof of purchase must be submitted to APB.

The Limited Warranty begins from the original owner's receipt or the date of purchase (whichever is later) and will be verified by APB ("Warranty Start Date").

Guaranteed Products

Warranted Products are warranted to be free from defects in materials and/or workmanship for the periods identified below:

• Bicycle Frame and Components: 2-year Limited Warranty from the Warranty Start Date for replacement of a defective frame, forks, stem, handlebars, headset, seat post, brakes, lights, bottom bracket, tires, wheel hub and reflectors.
• Battery: 2-year Limited Warranty from the Warranty Start Date or up to 300 recharge cycles (approximately 6,000 miles of use). Proper battery care and charging should result in up to 75% of original capacity during this period.
• Additional Frame & Components: 1-year Limited Warranty from Warranty Start Date for pedals, freewheel, crankset, cassette, derailleur, shifter and saddle.
• APB Brand Optional Accessories: 1-year Limited Warranty from Warranty Start Date.

Labor under the Limited Warranty

Labor will be provided for any Warranted Product with prior approval from RPB prior to performing service.

Wear and Deterioration

Wear and tear are not covered by this Limited Warranty. These terms describe damage or wear that occurs as a result of normal use. As a result, not all products are covered by this Limited Warranty. For example, your tires and tubes will wear down over time, which is not covered by this Limited Warranty. Additionally, items such as brake pads will wear down with use. For example, while the brake caliper is covered by the Limited Warranty, the brake pads are not. Additionally, scratches and other potential damage to the bike's paint or graphics due to normal use and exposure to the elements are not covered. Below is a non-exhaustive list of other typical wear and tear items:

• Brake pads
• Chains
• Dishes
• Front derailleur guide wheels (Part of the front derailleur assembly)
• Shift/brake cables and housings
• Hydraulic brake hose and fluid
• Tires
• Cameras
• Painting the picture / Decals
• Bearings (Headset, Bottom Bracket, Front Hub)
• Radios

This Limited Warranty Does Not Cover:

• Any damage or defect to the Warranted Products resulting from failure to follow instructions in the e-bike owner's manual, acts of God, accidents, misuse, neglect, abuse, commercial use, alterations, modifications, improper assembly, installation of parts or accessories not originally intended or compatible with the e-bike as sold, operator error, water damage, extreme riding, stunts, or improper follow-up maintenance.
• For the avoidance of doubt, APB shall not be liable for any damage, failure or loss caused by any unauthorized service or use of unauthorized parts.
• The battery is not warranted against damage resulting from power surges, use of an improper charger, improper maintenance or other misuse, normal wear and tear, or water damage.
• Rust or corrosion.
• Improper maintenance, assembly or installation.
• Using the electric bicycle for abnormal, competitive, commercial activities or any purpose beyond its intended design.
• Modifications of the original state.
• Modification, alteration or improper installation of components, parts or accessories not originally intended for or compatible with the electric bicycle.
• Damage to paint finishes and decals resulting from participating in competitions, jumping, downhill and/or training for such activities or events, or from exposing the bicycle to, or riding in, severe conditions or climates.

THE DETERMINATION OF WHETHER DAMAGE OR DEFECT TO AN ELECTRIC BICYCLE OR THE WARRANTED PRODUCTS IS PROTECTED BY THIS LIMITED WARRANTY SHALL BE AT THE SOLE DISCRETION OF RPB. PLEASE CONTACT APB CUSTOMER SERVICE IF YOU HAVE ANY QUESTIONS.

Claims Process

APB WILL NOT REPLACE ANY PRODUCT WARRANTED UNDER THIS LIMITED WARRANTY WITHOUT FIRST SEEING PHOTOS OR VIDEOS OF THE DAMAGED WARRANTED PRODUCT.

To exercise your right to receive a replacement for a Warranted Product under this Limited Warranty, you must:

• Contact APB's Customer Service team via our Help Center. The Customer Service team will initially work with you on your e-bike issue to identify possible simple solutions.
• If the Customer Service team determines that a Warranted Product needs to be replaced, you will be provided with a set of instructions to have an APB Authorized Service Provider fix the problem and/or return the defective Warranted Product for a replacement.
• After receiving your replacement Warranted Product, the Customer Service team will also assist you in determining how to replace or install the new Warranted Product on your e-bike.
• You will be responsible for shipping costs associated with the return of a Warranted Product unless APB agrees in writing to pay such shipping costs. Replacement Warranted Products under this Limited Warranty will only be shipped to the original purchaser's address.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND APB’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. UNDER NO CIRCUMSTANCES WILL RPB’S LIABILITY EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE E-BIKE, NOR UNDER NO CIRCUMSTANCES WILL RPB BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APB DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE FOR THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
